We wanted to provide some clarity regarding the new advertising restrictions that will enter into force in Belgium on 1 July 2023, following the publication of the Royal decree in the Official Belgian State Gazette on Wednesday 8 March 2023.
As you probably already know, the permitted forms of advertising will be severely limited given the new regulation’s underlying principle that only licence holders will be permitted to advertise under certain conditions and that all advertising for games of chance is prohibited unless explicitly allowed in the Royal decree.
Based on our first legal analysis, we understand that affiliate marketing will no longer be allowed as from 1 July 2023 as online only license holders are allowed to advertise on their own website and social media platforms and affiliate marketing is a form of advertising which is not explicitly allowed.
Please note that we are currently examining with our lawyers if there are workarounds to continue affiliate marketing in altered forms and we will be in touch nearer the time with further guidance.
To address your immediate concern, we will continue to pay revenue share after 1st July 2023 for any existing players referred to Unibet.be, under the terms of the program’s Terms & Conditions.
